The developers of Ringless Voicemail have the opinion that since their system doesn’t actually make the phone ring they’re not bound by the TCPA (Telephone Consumer Protection Act). The law that strictly mandates that your mobile number cannot be targeted by robocall campaigns (unless you gave specific permission but who would do that?)
But this relatively new technology is already facing some legal issues. A federal judge in Michigan has already ruled that a ringless voicemail or RVM is regulated by the Telephone Consumer Protection Act. https://www.jdsupra.com/legalnews/first-ringless-voicemail-message-tcpa-12645/ In addition Florida has passed a new law that makes direct to voice mail calls subject to all the regulations of TCPA and the “Do Not Call List” Okay, now that I’ve covered the legal challenges lets discuss the ethical viewpoint. I always try to base my marketing on how I personally would respond to it and to be 100% honest I can’t stand telemarketing calls of any kind. As a matter of fact a few years back I switched cable companies and got a phone line because it was included in their bundle package. I received so many telemarketing calls on that phone line within a couple days I just unplugged the phone. It was INCREDIBLY ANNOYING!!! So personally I think I’d have a hard time marketing to anyone using this kind of system because of the legal and ethical issues. But… I like to hear different viewpoints on topics such as this so do me a favor. Please comment below and tell me if you would use a ringless voicemail system and if you think it would be a good way to find motivated sellers, I’d really love to hear your opinion on this. I agree with you Dave. I don't appreciate those ringless voice mails so I won't be using them to market!
